By accessing and using this AI fashion photography platform ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Our Service provides AI-powered high-fashion editorial photography generation. Users upload 10-15 training photos to create a custom LoRA model, then select editorial prompts to generate professional fashion images using FLUX.2 LoRA technology with perfect face-matching.

3. Credits and Payment

The Service operates on a credit-based system where 1 credit = 1 generated image. Credits can be purchased through our pricing page in various pack sizes. All payments are processed securely through Stripe.

3.1 Pricing

Credit pack prices are displayed on our pricing page and may be updated from time to time. Any price changes will not affect credits already purchased.

3.2 Credit Expiration

Purchased credits do not expire and remain in your account indefinitely until used.

4. No Refunds Policy

IMPORTANT: Due to the digital nature of our Service and the computational costs involved in AI image generation, all sales are final and non-refundable. Once credits are purchased, they cannot be refunded, exchanged, or transferred. By purchasing credits, you acknowledge and agree to this no-refunds policy.

We recommend starting with our smallest credit pack (10 credits) to test the Service before purchasing larger packs.

5. Photo Upload Requirements and Consent

Before uploading any photos to our Service, you must confirm that you own or have explicit permission to use those photos for AI processing.

5.1 Photo Ownership and Rights

By uploading photos to our Service, you represent and warrant that:

• You are the original photographer or copyright holder of the uploaded photos, OR
• You have obtained explicit written permission from the copyright holder to use the photos for AI image generation, OR
• The photos are in the public domain or licensed under terms that permit this use
• You have obtained all necessary model releases and consents from any individuals depicted in the photos
• The photos do not infringe on any third-party intellectual property rights, privacy rights, or publicity rights

5.2 Prohibited Content

You must NOT upload:

• Photos of minors (individuals under 18 years old) without proper legal guardian consent
• Photos obtained without consent (e.g., photos taken from social media without permission)
• Professional photos taken by photographers unless you have their explicit permission
• Photos containing illegal content, nudity, violence, or offensive material
• Photos that violate any person's privacy, publicity, or other rights

5.3 Consent Requirement

When uploading photos, you must check the consent box confirming that you have the legal right to upload and process the images. This consent is legally binding and you accept full responsibility for any violations of third-party rights.

5.4 Indemnification

You agree to indemnify and hold harmless Fashion AI Twin and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your upload of photos that violate these terms or infringe on third-party rights.

6. User Responsibilities

You agree to:

• Provide accurate and complete information when creating an account
• Comply with all photo upload requirements outlined in Section 5
• Not use the Service for illegal, harmful, or offensive purposes
• Not attempt to reverse engineer or exploit the Service
• Report any technical issues or content violations to our support team

7. Intellectual Property and Usage Rights

7.1 Your Content

You retain all rights to the photos you upload. By uploading photos, you grant us a limited license to process them for the purpose of generating images.

7.2 Generated Images

You own the generated images and have full commercial usage rights. You may use generated images for any legal purpose including but not limited to: personal use, social media, marketing, portfolios, and commercial projects.

7.3 Service Content

All editorial prompts, website design, and Service infrastructure remain our intellectual property.

8. Service Limitations and Disclaimers

8.1 AI-Generated Content

Generated images are created by artificial intelligence and may contain imperfections, anatomical inaccuracies, or unexpected results. While we strive for high quality, we cannot guarantee perfect results for every generation.

8.2 Service Availability

We aim to provide continuous service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

8.3 Generation Time

Image generation typically takes 30-60 seconds per image but may vary based on system load.

9. Prohibited Uses

You may not use the Service to:

• Generate images for illegal purposes
• Create deepfakes or misleading content
• Violate any person's privacy or publicity rights
• Generate content that is defamatory, obscene, or offensive
• Impersonate any person without consent

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, any unused credits will be forfeited without refund.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of the modified terms.

13. Governing Law
